INTRODUCTION:

Welcome to Dgency Global! We're excited to provide you with services across five key areas, all subject to the following terms and conditions. Before you dive into our services, we recommend reviewing this document along with our privacy policy.

Acceptance of Terms and Conditions:

By engaging with us, whether as an advertiser, specialist, or agent, you agree to the summary of payments, service terms, and cancellation policies outlined herein. These terms are accepted via email confirmation link or by checking the "acknowledgment" box and clicking "submit" after reviewing this document.

Failure to accept these terms within 30 days of presentation will result in withdrawal of the offer. However, advertisers are welcome to request services again, subject to new estimates and terms.

Three-Day Cancellation:

If you choose not to proceed within three working days, you may cancel services by emailing your name, business name, contact details, and request to cancel to info@dgencyglobal.com with "Cancellation Request" in the subject line. Advertiser assumes responsibility for any incurred service costs.

Personal Information:

Upon acceptance of these terms, you consent to receive information from Dgency Global regarding your account and the services we provide, including promotional messages and offers. To unsubscribe from marketing messages, email us with the subject line "Opt-Out of Marketing Messages" to info@dgencyglobal.com, ensuring you include your name in the email.

Regardless of acceptance, any provided data is subject to our privacy policy.

Description of Services:

Dgency Global will promote advertisers' businesses through various online strategies and platforms. Our services are tailored to meet your marketing needs.

Our current offerings may vary and are detailed on our website. Advertiser-specific terms and conditions apply to each service, which can be accessed through the provided links.

Advertiser Account Information:

Upon engagement, Advertisers will receive an Account Information Page to track account status and services provided by Dgency Global. Advertisers can also inquire about current services via call, chat, or email.

Fees for Dgency Global:

Advertisers can inquire about fees and pricing for any service via phone, chat, or email. Charges are detailed in the individual service terms and conditions. By accepting these terms, you agree to pay the specified fees communicated to you.

Payment:

Advertisers must use either credit card payment or a bank cheque made out to Dgency Global. By providing payment information, you authorize Dgency Global or its authorized merchant services provider to process payments.

Late Payments:

While every effort is made to avoid late payments, it's the advertiser's responsibility to ensure payment methods are up to date. Late payments are subject to a late fee and may incur additional collection costs.

Recurring Payments and Term of Agreement:

Services are billed as a one-time or recurring payment, as outlined in the service terms. Recurring payments can be canceled with prior notice

Early Termination Fee:

Advertisers terminating services before the contract term ends may be subject to an early termination fee equivalent to the remaining contract value.

Modification:

Dgency Global reserves the right to modify terms, conditions, and service offerings with 30 days' notice. Advertisers are encouraged to enter long-term contracts to lock in pricing and terms.

Access:

Advertisers have access to Dgency Global's platforms to manage their advertising accounts. However, automated scripts or unauthorized access are prohibited.

Latency:

Data provided by advertisers may be subject to processing delays due to internet latency and system factors.

Ownership of Non-Advertiser Property:

All services, technologies, and materials provided by Dgency Global remain the property of Dgency Global or its partners. Advertisers do not acquire ownership rights.

Advertiser's Site:

Unless provided by Dgency Global, advertisers are responsible for the development and maintenance of their websites. Dgency Global is not responsible for website operations or content.

Advertiser Representations and Warranties:

Advertisers represent that they have the authority to enter into this agreement and provide necessary materials for services. Advertiser content must comply with legal and ethical standards.

Advertiser Covenants:

Advertisers agree not to hold Dgency Global liable for visitor actions on their websites. Advertisers also agree to certain restrictions regarding employment and promotion of Dgency Global's employees and contractors.

Advertiser Indemnification Obligations:

Advertisers agree to indemnify Dgency Global against any claims arising from advertiser conduct or content.

Limitation of Liability and Warranty Disclaimer:

Dgency Global is not liable for internet interruptions or errors in service. Service errors do not entitle advertisers to refunds.

Additional Assistance:

Any additional assistance requested by advertisers is subject to the limitations of liability outlined in this agreement.

Choice of Law:

All disputes arising from this agreement shall be governed by the laws of the United States of America, with exclusive venue in a court of competent jurisdiction.

Section headings are not part of the agreement and do not accurately reflect its contents.

Attorneys' Fees:

In the event of a dispute, the prevailing party may recover attorneys' fees from the non-prevailing party.

No Third Party Beneficiaries:

This agreement is solely for the benefit of the parties involved and does not confer rights upon any third parties.

Survival:

Certain provisions of this agreement will survive termination.

Website Content Policy:

For website projects, content will be provided by the client. E-commerce websites may include sample products provided by Dgency Global and client-provided product information. Content management is handled by Dgency Global

Refund Policy:

Our refund policy ensures customer satisfaction. Refund requests must be made within specified timeframes and are subject to processing fees.

Dispute Resolution:

Disputes must be submitted to mediation and, if unresolved, to arbitration administered by the American Arbitration Association.

Quality Assurance Policy:

We strive to deliver high-quality designs tailored to your needs, offering unlimited revisions until satisfaction.

Delivery Policy:

Design orders are delivered as per the order confirmation date. Timelines vary depending on the project type.

Revision Policy:

Clients can request revisions within the specified timeframe, with timelines varying by project type.

Ownership of the Work:

Upon final payment, clients own all rights to the design.

Copyrights & Trademarks:

Clients retain full ownership of designs, with Dgency Global retaining promotional use rights.

Record Maintenance:

We maintain design records for six months.

Communication Policy:

We communicate through designated email addresses and toll-free numbers for customer support.

Customer Support:

We offer 24-hour customer support via phone, chat, or email for any queries or assistance needed.
